Question

What is a dynasty trust?

Answer

A dynasty trust is a long-term irrevocable trust designed to transfer wealth across multiple generations while minimizing estate and generation-skipping transfer (GST) tax. In states without a rule against perpetuities — such as South Dakota, Nevada, Delaware, Alaska, and Wyoming — depending on the trust structure and applicable state law, a dynasty trust may provide an opportunity to preserve assets for future generations.

This structure works best for ultra-high-net-worth families that can use the full $15 million ($30 million for couples) GST exemption. Keeping assets in trust rather than distributing them outright can help protect your wealth from estate taxes, creditors, and divorce at each generation. Work with your estate attorney to confirm whether your state’s laws support this approach.
